eIDAS framework

Simple, advanced and qualified signature under eIDAS

EU Regulation 910/2014 (eIDAS) distinguishes three levels of electronic signature with different legal effects. Choose the level based on the legal risk and the burden of proof you need.

Level Legal equivalence (eIDAS article) Dokuflex method Typical use case Burden of proof
Simple (SES) Conditional validity (eIDAS art. 25.1) Acceptance click + IP/email Quote acceptance, low-risk NDA Falls on the signer
Advanced (AES) Unique identification and integrity (eIDAS art. 26) Graphometric biometric + SMS OTP Employment contract, commercial agreement, healthcare consent Falls on whoever produces the contract
Qualified (QES) Equivalent to handwritten signature (eIDAS art. 25.2) FNMT / DNIe / Cl@ve certificate / qualified eIDAS trust service provider Mortgage, public administration filings, notarial deed Falls on whoever challenges the signature

Frequently asked questions

What we hear most often

What signature types does Dokuflex support?

Graphometric biometric, SMS OTP, digital certificate (DNIe, FNMT, Cl@ve) and qualified eIDAS signature with trust service providers. Each use case matched to the right legal level.

Is it legally valid in court?

Yes. It complies with eIDAS (EU Regulation 910/2014) and Spain's Law 6/2020 on electronic trust services. Each signature generates a PDF/A audit report with XAdES, time-stamping and encrypted graphometric evidence.

Does the signer need to install anything?

No. They sign from any browser on mobile, tablet or PC. No app, no signup, no downloads. In under 30 seconds.

How much does it cost?

Start free, no credit card. Plans from EUR 0.50 per signature or flat rate by volume. Cancel anytime.

What if the signer doesn't know how to use it?

Dokuflex guides the signer step by step with instructions in their language. Average completion rate of 96% on the first attempt, even with non-digital users.

What is the difference between simple, advanced and qualified electronic signature?

EU Regulation 910/2014 (eIDAS) defines three levels. The simple electronic signature (SES) has conditional validity (art. 25.1 eIDAS) and is used for low-risk acceptances. The advanced electronic signature (AES), governed by art. 26 eIDAS, uniquely identifies the signer and detects any later modification; Dokuflex's graphometric biometric signature operates at this level. The qualified electronic signature (QES), created with a qualified signature creation device and a certificate from a qualified trust service provider (art. 25.2 eIDAS), has legal effect equivalent to a handwritten signature.

When do I need a qualified electronic signature (QES) instead of advanced (AES)?

A qualified electronic signature (QES) is required or recommended when the law mandates a handwritten signature or when interacting with public authorities that require it: deeds, mortgages, notarial acts, certain tax filings and specific administrative procedures. For employment contracts, commercial agreements, purchase orders, healthcare consents or NDAs, the advanced electronic signature (AES) with graphometric evidence or OTP is typically sufficient and more operational.

Is biometric signature an AES or a QES?

Dokuflex's graphometric biometric signature is an advanced electronic signature (AES) under article 26 of EU Regulation 910/2014 (eIDAS), with evidentiary weight reinforced by encrypted graphometric data (pressure, speed, acceleration and stroke), suitable for forensic handwriting analysis. It is not a qualified electronic signature (QES) by itself, but it can be combined with a qualified certificate from a trust service provider to reach the QES level.
